3. Account Basics & Security

• Account Responsibility: You are responsible for keeping your account secure. We strongly recommend you use two-factor authentication. We are not responsible for any loss or damage resulting from unauthorized access to your account if you fail to keep your login details secure.
• Your Content: You are responsible for all content and activity under your account.
• Age Requirement: You must be at least 16 years old to use Cloudfident AI. If you are under 18, you must have the permission of your parent or legal guardian.
• Human Users Only: Accounts created by bots or automated systems are not allowed and may be terminated.

4. User Conduct & Prohibited Activities

We want Cloudfident AI to be a safe and productive space for everyone. You agree to use Cloudfident AI responsibly and not for any harmful or illegal purposes. You specifically agree not to:

• Systematically collect data without written permission
• Try to trick or defraud us or other users
• Interfere with security features of the Platform

5. Your Content in Cloudfident AI

License to Operate the Service: By using Cloudfident AI, you grant us a license to use your content solely to operate and improve the Services for you. This includes storing and backing up your data, displaying your generated content within the Platform, and processing your data to provide features.

No Public Sharing: We will not publicly share, sell, or distribute your generated content.

Content Removal: We reserve the right to remove content that violates these Terms and may suspend or terminate your account for serious violations.

6. Purchases, Payments, and Subscriptions

• Payment Methods: We accept payments through Stripe.
• Pricing Changes: We will notify you of price changes in advance, applying only to subsequent billing periods.
• Billing Cycle: Subscriptions are billed monthly and automatically renew unless cancelled.
• Cancellation: Canceling your subscription will prevent future charges. Your access continues until the end of your current billing period.
• Refund Policy: You can request a refund by contacting hello@cloudfident.ai within two (2) months of your purchase.

7. Availability

Cloudfident AI is provided on a "best effort" basis. While we do backups and ensure redundancy, service may be unavailable due to maintenance or technical issues. You should maintain your own copies of important content.

8. Intellectual Property

Our Intellectual Property: We own all rights to the Cloudfident AI Platform, including its design, code, trademarks, and logos.

Your Use of the Services: You are granted a non-exclusive, non-transferable, revocable license to use Cloudfident AI for your personal, educational, and professional learning.

AI-Generated Content: You retain rights to content you generate through the Platform for personal and educational use.

9. Disclaimer of Warranties

Cloudfident AI is provided "as is" and "as available," without warranties of any kind, express or implied. We make no warranties about the accuracy, reliability, or suitability of the service or any content generated by Cloudfident AI.

10. Limitation of Liability

In no event will we be liable for any direct, indirect, consequential, or punitive damages, including lost profit, revenue, or data arising from your use of the services. Our total liability is limited to the amount paid by you during the two (2) months prior to any claim.

11. Indemnification

You agree to protect us from any claims or damages that arise from your use of Cloudfident AI, including your use of AI-generated content, violation of these Terms, or harm to other users.

12. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of Spain, excluding its conflict of laws principles.

Dispute Resolution: We encourage you to contact us directly at hello@cloudfident.ai to resolve any issues informally. If we cannot resolve a dispute amicably, any legal disputes will be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

13. Term and Termination

These Terms are effective as long as you use Cloudfident AI. We may terminate your account and access to the Services at any time if you violate these Terms. You may also terminate your account at any time by canceling your subscription and requesting account deletion.

14. Modifications and Interruptions

We may modify, suspend, or discontinue Cloudfident AI (or any part of it) at any time without notice. We will not be liable for any loss, damage, or inconvenience resulting from such modifications, suspensions, or interruptions.

15. Miscellaneous

• These Terms constitute the entire agreement between you and us regarding Cloudfident AI.
• Our failure to enforce any provision does not waive that provision.
• If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
• We may assign our rights and obligations under these Terms. You may not assign yours.
• No partnership, joint venture, employment, or agency relationship is created by these Terms.
